Practice Profile

Meghann McTague joined 2 Temple Gardens in September 2009 having moved from chambers in Manchester where she enjoyed a busy, mixed common law practice. With a background of experience at both the Criminal Bar and in civil practice, she is an experienced and determined advocate who has appeared in front of a range of tribunals.

From 2006 to 2009 she was instructed by the Treasury Solicitor as junior counsel, led by Rory Phillips QC, on the Rosemary Nelson Inquiry based in both London and Belfast.   As a result of this experience she has a particular skill for assimilating large volumes of complex documentary evidence thoroughly and quickly.

Before coming to the Bar, Meghann worked as a management consultant for clients in both the public and private sector and therefore, brings a practical understanding of the needs of the commercial sector to her practice.

Meghann currently carries out work within all of Chamber’s core practice areas with a particular interest in personal injury cases and international travel law.

 

Personal Injury

Meghann regularly appears in front of Circuit Judges and District Judges in the County Court in the full spectrum of contested final and interim hearings on behalf of both claimants and defendants.

In her personal injury practice, she has the advantage of a range of experience in different practice areas enabling her to provide continuity for clients dealing with the aftermath of an accident at work. Meghann can provide advice and assistance from the pre-action stage, the inquest, any criminal prosecution through to the claim for personal injury. 

A recent example of Meghann’s crossover expertise is her work on a case involving the prosecution of an Italian shipping company following the death of one its employees in the United Kingdom.  In the course of this case, Meghann gained a detailed knowledge of the regulatory system for, and investigation of, accidents at sea at an international and domestic level.

Meghann drafts pleadings, detailed schedules and counter-schedules of loss and advises on all levels of personal injury claims in all areas including occupiers’ liability cases, employers’ liability cases, claims arising out of road traffic accidents and credit hire cases.

International Travel

Meghann has a particular interest in International Travel cases including claims involving the Package Travel Regulations 1992, the Athens Convention 1974 and claims arising from accidents abroad generally. 

In addition to her broad range of personal injury experience in the County Court, Meghann has appeared in the Admiralty Court and has experience of drafting detailed Defences to claims under the Athens Convention 1974.

She has recently published an article on the interpretation of Article 4 of Rome II following the case of Jacobs v MIB [2010] EWHC 231 (QB) in which Dermod O’Brien QC and Marie Louise Kinsler of 2tg successfully appeared on behalf of the Defendant. (Article ‘Rome to...? Health & Safety

With a background in criminal, regulatory matters, Meghann has a wealth of experience of acting both for and against public bodies in all hearings from the Magistrates’ to the Crown Court. She has both prosecuted and defended in food hygiene cases, trading standards cases and environmental cases.

Meghann represents appellants and respondents in appeals against abatement notices in Statutory Nuisance cases pursuant to the Environmental Protection Act 1990; in particular odour abatement.

Meghann was recently involved in the case of R v EGS Limited [2009] EWCA Crim 1942 (involving the Prosecution’s appeal against the Defendant’s successful submissions of no case to answer) which re-affirmed the approach of the House of Lords in R v Chargot (t/a Contract Services) Limited [2008] UKHL 73.

In 2009 she was appointed to the Attorney General’s Unified List of Prosecuting Advocates.

Meghann has experience of a number of inquests including representing a construction company in a complex jury inquest.

She has delivered training to a number of local authority solicitors on a range of topics from their investigatory powers to succeeding at trial.  She has also delivered seminars on Health and Safety at Work and is available to deliver practical training sessions in-house on this topic to those representing and insuring potential defendants.

 

Public Law

The Rosemary Nelson Inquiry has considered allegations of Government collusion in the murder of a solicitor based in Northern Ireland in 1999. Full participants include the Ministry of Defence, the Police Service Northern Ireland, the Northern Ireland Office and the Security Service.  

Meghann was involved in the Inquiry throughout the preparatory stages, the oral hearings, and also advised the Inquiry Panel on the delivery of its report.  Witnesses to the Inquiry included senior politicians, the former Chief Constable, experienced Special Branch officers and expert witnesses.

In light of this experience, Meghann has particular expertise in advising and representing parties to an Inquiry at all stages of the Inquiry’s process including advising on issues arising from the Human Rights Act 1998 and Public Interest Immunity.
