Court of Appeal hands down judgment in Sahin v Havard & Riverstone Insurance [2016] EWCA Civ 1202

John McDonald appeared for Riverstone Insurance instructed by BLM Southampton, and successfully resisted an appeal from Central London County Court.

The main issue in the appeal was whether a Monk v. Warbey liability (i.e. for causing or permitting someone else to drive without insurance) was a liability which was itself required by the Road Traffic Act 1988 or European law to be covered by insurance. The Court upheld the decision below that such a liability was not required to be covered by insurance, and reaffirmed that the UK motor insurance system, including the MIB schemes, complied with the aims and spirit of the EU Motor Insurance Directive.
