Court of Appeal Victory for Paul Downes QC and Emily Saunderson

Paul Downes QC and Emily Saunderson represented the successful Appellant in Globe Motors v TRW Lucas Varity [2016] EWCA Civ 396, judgment in which was handed down on 20th April 2016. The case concerned the proper construction of an exclusive supply agreement for electric motors used in power steering systems for cars. The Court of Appeal overturned the decision of the trial judge and provided guidance on the treatment of “anti-variation” clauses precluding variations that are not recorded in writing, an area in respect of which there were previously inconsistent Court of Appeal decisions.
