Clinical Negligence

At 2TG, we act for both claimants and defendants in healthcare and clinical negligence cases. We relish the dual demands of knowing the law and understanding the medicine. We are instructed in disputes involving the full range of medical disciplines including obstetrics, surgery, physiology, psychiatry, neurology and dentistry.

Our work involves multi-million pound damages claims involving multiple experts and leading-edge medical techniques. It also involves negligence suffered by individuals through human error, system failure and communication breakdown. Our clients value our compassionate understanding and genuine concern for claimants, our ability to test the mettle of clinicians while maintaining their confidence and our rigorous approach to difficult issues of quantum and liability.

We act for the NHS Litigation Authority, the MDU, insurers of private healthcare providers, the General Medical Council, the General Dental Council, private hospitals and Welsh NHS bodies as well as for ancillary professions and a wide variety of claimants.

In addition to providing specialist advice and advocacy for a wide variety of claimants and defendants in the healthcare field, we have experience of appearing before professional bodies in disciplinary and regulatory hearings and at inquests.

Our barristers are well known for dealing with claims in relation to clinical and pharmaceutical products where disputes frequently arise as a result of allegedly defective products. This includes ongoing actions in relation to problematic vaginal, pelvic and rectal mesh surgery, lens and hip replacement surgery and group actions concerning drugs and breast implants and sterilisation devices.

Equally highly regarded is the set’s expertise in other complementary and interlinked areas such as private international law, advising on issues of jurisdiction, choice of law and conflicts of law in cross-border clinical negligence disputes.
