We have unrivalled expertise in all types of property damage claims, including those originating from floods and storms, fires, explosions, impact and subsidence, including tree roots.

We have consequently appeared in most of the leading cases in this field in recent years and currently have several members working on the Grenfell fire litigation.

Our experience of property damage claims ranges from complex litigation arising out of multi-national construction, energy and utility projects to liability issues associated with domestic tree root subsidence. We have specific expertise in electricity, gas and water cases. We also deal with many disputes arising from defective products, such as the well-publicised issue with cladding, which allows us to draw on our market leading product liability practice. We have a keen understanding of the highly technical evidence required in these cases and our clients value our appreciation of some of the finer and more idiosyncratic issues of law which arise.

Typically, property damage claims are complex and require consideration of many different areas of law including insurance, professional negligence, construction, product liability and matters of jurisdiction. We are also experienced in the issues of nuisance, Rylands v Fletcher, ignis suus and vicarious liability which frequently arise in property damage claims. With recognised expertise in all these disciplines the set is highly sought after and able to add significant value on disputes of this nature.

We are instructed by all the leading insurers, and act in subrogated recovery actions and for those defending liability claims. Our property damage expertise extends to advising on all related insurance and construction issues including coverage under commercial, domestic and CAR policies, as well as regularly dealing with all major standard form building contracts.

Members of Chambers have recently written “The Law of Property Damage”, the leading text published by Bloomsbury Professional. We also host an annual conference “Damage Day” which is widely regarded as the principal event for property damage practitioners.
