Alistair Mackenzie successful in Court of Appeal on jurisdiction

Judgment has been handed down today in Stait v Cosmos Insurance Limited [2022] EWCA Civ 1429, in which Alistair Mackenzie acted for the successful Defendant.

The Court of Appeal determined that the English courts had no jurisdiction in a claim brought by a member of the Armed Forces serving on a sovereign base in Cyprus. In determining that the Claimant was not domiciled in England and Wales at the material time, the Court of Appeal underlined the factual nature of the test for residence, and the distinction between residence and other connections to the jurisdiction.
