The Court of Appeal today handed down judgment in Roberts v SSAFA  EWCA Civ 926, an important decision on the question of whether the Civil Liability (Contribution) Act 1978 applies irrespective of choice of law. The Court of Appeal concluded that on a true construction the 1978 Act has extra-territorial effect, irrespective of the law that would otherwise apply to the question of contribution under the relevant choice of law rules.
