Important Court of Appeal decision on choice of law and contribution

Posted: 17/07/2020

The Court of Appeal today handed down judgment in Roberts v SSAFA [2020] EWCA Civ 926, an important decision on the question of whether the Civil Liability (Contribution) Act 1978 applies irrespective of choice of law. The Court of Appeal concluded that on a true construction the 1978 Act has extra-territorial effect, irrespective of the law that would otherwise apply to the question of contribution under the relevant choice of law rules. A copy of the judgment can be found here.

Charles Dougherty QC, of 2TG, instructed by DAC Beachcroft appeared for the Appellant. Charles Hollander QC, instructed by the Government Legal Department, appeared for the Respondents
