Isabel Barter successful in preventing £16m professional negligence claim from continuing

Isabel Barter successfully prevented a £16m claim against the Defendant Receivers for breach of equitable duty from proceeding. At the preliminary issue trial in 2020, the Court held that the Receivers would only be liable for such breach where the liability was directly caused by (a) gross negligence or (b) wilful misconduct. The Claimant therefore needed to amend its pleadings. The result of the recent CCMC (which ran for 2.5 days) is that the Claimant cannot bring a claim on either basis.
