Andrew Bershadski successful in professional negligence claim against Leigh Day

Andrew Bershadski, instructed by Harding Mitchell, were today successful in a High Court action on behalf of 4,752 claimants against their former solicitors, Leigh Day: Agouman v Leigh Day [2016] EWHC 1324 (QB). Leigh Day had secured a settlement for some 30,000 clients in 2009 in respect of personal injuries arising from the dumping of toxic waste in Abidjan, Ivory Coast. Leigh Day arranged for the entirety of the £30m settlement to be paid into an account in the Ivory Coast. Approximately £6m of the £30m was stolen through a fraud, perpetuated in part by corrupt decisions of the Ivory Coast courts. Andrew Smith J. found that Leigh Day were negligent in failing to undertake a sufficiently rigorous analysis of the risks of holding such a significant sum of money in the Ivory Coast, and that this failure led to the monies being stolen.
