We are naturally experienced in all issues arising out of dismissal and termination, such as unfair dismissal, wrongful dismissal, whistleblowing, flexible working, TUPE following business transfers and takeovers, and sick and holiday pay.

In relation to departures, we regularly advise on employment contracts and exit agreements, including on issues arising such as breach of confidence/fiduciary duty, diversion of business opportunities, competitive behaviour and activity, misappropriation of confidential information, partnership disputes, team moves, restrictive covenants and shareholder rights and obligations.

We are true specialists in dealing with urgent interim applications, appearing in numerous cases applying for or resisting orders to restrain the unlawful activities of former employees and to protect confidential information, gardening leave injunctions as well as various disclosure, search and freezing orders, such as imaging orders, delivery up orders as well as springboard and prohibitory injunctions.  We also appear in committal applications where employees, directors and officers have been sentenced for breaching such injunctions.

We are active in international employment matters with a particular interest in cross-jurisdiction contracts and conflict of law issues. On this international stage our group litigation team has an excellent reputation for dealing with matters regarding the inter-related area of business human rights, and the duties, responsibilities and accountability of multinational corporations to workers of subsidiary companies domiciled abroad. These cases raise important and complex issues including jurisdiction, parent company/vicarious liability, tort, limitation, and contribution.

Our specialists in insurance can advise businesses in relation to relevant management liability policy coverage so as to protect and minimise exposure to claims arising from employment. Expertise includes directors’ and officers’ liability, cyber liability and employment practices liability.
