At 2TG, our employment barristers are experienced in assisting with and conducting investigations into allegations of misconduct in the workplace.
Our involvement ranges from limited advice in relation to interviews and the collection of evidence, to managing the complete life cycle of entire investigations. The scope of investigations extends from relatively straightforward and minor disciplinary and grievance matters, involving one individual, to collective complaints in relation to universal contractual terms and conditions or issues concerning negative work environments and corporate cultures.
The nature of investigations covers all manner of employment law including allegations of bullying or harassment, discrimination or whistleblowing, victimisation, misconduct and disciplinary matters, as well as independent investigations into senior executives for suspected fraud and serious regulatory breaches. We are acutely aware of the need for a watertight investigative process which will withstand legal scrutiny should litigation arise further down the line. We are naturally sensitive and are expert at balancing the competing perspectives of all parties, be it the employer, the employee, those implicated or those bringing the complaint.
We have considerable experience across a wide range of industry areas especially healthcare, professional and financial services, and local government, so are able to bring to bear our knowledge of these sectors when carrying out investigations.
We are perhaps best known for our work in the field of sport where we are at the cutting edge of this fast-growing area of law. Our barristers conduct investigations for clubs, national governing bodies, individual athletes and coaches across a wide range of sports including rugby, cricket, motorsports, tennis, golf, gymnastics and football. Generally, investigations are in relation to breaches of regulation, disciplinary issues or allegations of discrimination and bullying, many of which are highly publicised.
