We appear in international courts and arbitral tribunals all over the world, frequently acting on complex multi-jurisdictional disputes. We are particularly well-known for managing cross border litigation on matters of jurisdiction and applicable law and appear regularly in the Supreme Court and Court of Appeal.

At 2TG, our barristers have considerable product liability experience in cases involving injury caused by allegedly defective medical devices, pharmaceutical products and medicines.
The nature of these cases means that many are run as group actions and across borders. We are accordingly expert at running mass and international tort litigation in relation to clinical equipment and pharmaceutical claims including, for example, group litigation associated with breast implants and sterilisation devices, vaginal and rectal mesh, metal hips and replacement lenses, and those regarding the effects of drugs and vaccinations. Members are also frequently instructed in a variety of individual or smaller group actions involving well known manufacturers and international brands, concerning claims in relation to cosmetic and bathroom products and devices.
We have been involved in many of the key and leading cases of recent years, including litigation concerning Corin Metal-on-Metal hips, PIP breast implants, Essure sterilisation devices, TVT mesh and Oculentis intra-ocular lenses. We also acted on high profile claims in relation to the MMR vaccination and medicines such as the anti-malarial drug, Lariam, the anti-sickness drug, Thalidomide, and the medical dye, Myodil.
Our experience in this area means members of our chambers are frequently instructed in the high-profile inquiries in the clinical field. For example we are currently working, or have recently worked, on the Thirlwall Inquiry, the UK Covid-19 inquiry and the Infected Blood Inquiry.
We have experience in all aspects of product liability and advise on legal and contractual liability, exposure, policy drafting and interpretation, reputational risk, insurance coverage and cross border and multi-jurisdictional issues. Naturally the practice ties in with 2TG’s market leading and related expertise in insurance, clinical negligence, and personal injury. We also have particular expertise in cross border product liability litigation and the complex jurisdiction and private international law issues arising in such claims.
As a set, we also have in depth experience of high-profile, technically difficult matters involving a wide range of other products including, household and electrical goods, automotive products, construction apparatus, engineering machinery and other heavy industry equipment.
