As tackling fraud remains a strategic industry priority for the insurance market, there is an increase in the need for specialist legal and technical advice in relation to identifying and prosecuting insurance fraud.
At 2TG, we are at the forefront of advising on cases of this nature and are highly experienced in all types of fraudulent claims in a variety of contexts, including in relation to direct and indirect claims on policies. We are particularly well known for acting for the insurance market, although we also act for claimants and insureds.
We draw on our considerable expertise in personal injury, insurance, property damage, travel, clinical negligence and product liability when advising on matters of alleged fraud, and clients come to us for our ability to apply this specialist knowledge to suspected fraudulent claims. For example, our understanding of the law relating to property damage, where the nature of causation can be extremely technical, provides us with excellent insight into claims alleging arson. Our expertise in travel law supports our ability to assess exaggerated and dishonest claims relating to holiday insurance. We also deal with fraudulent claims relating to other specialist insurance cover including home and art or antiquities policies.
In relation to motor fraud, we have significant experience of defending dishonest motor vehicle claims including staged/no accident claims, low velocity/no injury claims, declarations for policy avoidance and credit hire issues, as well as exaggerated and other dishonest claims. Many of us also have specialist knowledge of working on cases concerning organised fraudulent activity, involving suspected fraud rings. We are retained on national insurer panels to deal with late notification claims and suspected fraudulent road traffic accidents.
In addition to this, we are particularly well regarded for our work in the healthcare sector, dealing with claims relating to life insurance (including faked deaths) and permanent health insurance where fraud is not uncommon. We are very experienced in high value fundamental dishonesty personal injury and clinical negligence claims and are also instructed to advise on committal proceedings.
We are also well placed to act on cross border fraud cases or those with an international element of any kind due to our expertise in private international law. Members provide specialist advice on the jurisdictional elements of disputes and issues of applicable law.
