At 2TG, product liability is one of the areas for which we are best known.
We have in-depth experience of high-profile, technically difficult matters involving a wide range of products including pharmaceuticals, medical devices, foodstuffs, household and electrical goods, heavy industry and agricultural machinery, automotive products, and construction and engineering equipment.
Our barristers have experience in all aspects of product liability and advise on legal and contractual liability, exposure, policy drafting and interpretation, reputational risk, insurance coverage, and cross border and multi-jurisdictional issues.
The nature of product liability cases means that many are run as group actions and across borders. We are accordingly expert at running mass and international tort litigation and are routinely involved in all the leading cases in the field. Examples include acting in litigation relating to metal hips, diesel emissions, cladding, inter-ocular lens replacement, breast and sterilisation implants, vaginal mesh and cases regarding the effects of drugs and vaccinations. These group litigation cases tend to take years to run their course.
Our product liability practice ties in with our market leading expertise in insurance, in relation to coverage and policy drafting, clinical negligence and personal injury, in relation to medical devices and pharmaceutical claims, and property damage, when defective products cause property damage by way of fire or otherwise.
Our strength in private international law and commercial work helps us handle cross-border claims, including claims down the supply chain, where issues of jurisdiction and applicable law arise. We are able to draw on the experience and knowledge developed across this breadth of areas which means that our barristers can service a wide range of industry areas and product types.
