Luka Krsljanin succeeds in High Court clinical negligence defence
Nicol J has handed down judgment in the case of Manzi v King’s College Hospital NHS Trust  EWHC 1101 (QB). The case involved a complex factual dispute as to the quantity of retained placenta allegedly left in the Claimant’s uterus after child birth.
The Court had to consider the issue of adverse inferences in circumstances where a doctor tangentially involved in treating the Claimant was not called to give evidence. Luka was successful in arguing that no adverse inference should be drawn in the circumstances.
