In the final instalment of this long-running clinical negligence litigation, HHJ Glen (sitting as a Judge of the High Court) dismissed the claimant’s claim for damages arising out of the death of her husband. The court found against the claimant on both breach of duty and causation. The judgment is an important reminder of the Bolam test, the court having formed the impression the claimant’s cardiology expert “was telling [the judge] what he thinks he would have done rather than what others might have done”. It also recognises the practical realities of hospital medicine: “… Clinicians treat the individual in front of them. There is no checklist. They do not hold the ESC Guidelines or the American Guidelines in one hand as they decide how to treat an individual patient.”
