Hayley McLorinan specialises in personal injury, property damage, product liability and employment litigation.
She is an experienced advocate, who regularly appears in court instructed by both claimants and defendants. She is known for her ability to digest complex issues quickly and provide straightforward and commercial advice.
In personal injury, Hayley’s work covers a broad spectrum including catastrophic injury, public liability, occupiers’ liability and defective premises, Road Traffic, Highways Act, food poisoning, Animals Act and product liability claims. She has extensive experience of employer’s liability claims, including industrial disease and psychiatric injury, bringing additional employment law expertise to the table.
Hayley’s expertise in property damage makes her especially well placed to deal with claims encompassing both personal injury and property damage elements such as housing disrepair / defective premises claims, product liability claims and motoring incidents causing property damage.
Hayley regularly undertakes drafting and advisory work in addition to a busy advocacy practice. She regularly appears in the County Court and High Court in addition to having experience of inquests and mediations.
Hayley practices in all aspects of property damage. Cases in which she is instructed commonly raise complex technical matters including contested issues of causation. In particular, Hayley has experience of claims relating to fires, floods, construction work and subsidence. She is regularly instructed in subrogated recovery claims and claims for indemnity insurers involving multiple experts.
Hayley’s practice covers a wide range of product liability issues, acting for both claimants and defendants. Her experience in this area is complimented by her expertise in both personal injury and property damage litigation.
Examples of products Hayley has dealt with include: white goods, boats, electrical components, bicycles, flood warning systems, infant safety products, kitchen equipment, electronic cigarettes, toys and foodstuffs. She advises on complex liability, quantum and policy coverage issues.
Hayley regularly undertakes advisory and drafting work in employment matters and frequently appears in the Employment Tribunal on behalf of both claimants and respondents. She has acted for public authorities, NHS Trusts and private employers. Her experience covers unfair dismissal, including constructive unfair dismissal, redundancy, equal pay, discrimination and victimisation, wrongful dismissal and TUPE claims.
Hayley has wide experience of general contractual disputes, including claims involving the sale and supply of goods and services. She is regularly instructed in credit hire litigation.
Hayley has experience of insurance claims including policy interpretation, breach of notification clauses and non-disclosure.

The type of personal information I collect
To enable me to provide you with legal advice and representation in courts, tribunals, arbitrations and mediations, I currently collect and process the following personal information:
Personal identifiers, contacts and characteristics (for example, name, date of birth and contact details), bank and financial details, your background and circumstance and education.
Other personal data relevant to, or included in instructions to provide legal services, including data specific to the instructions in question and data included in documents provided to me as part of instructions or otherwise.

By providing such personal information to me, you automatically confirm that you are authorised to do so. It is not reasonably practicable for me to provide the information set out in this Privacy Notice to those individuals. Accordingly, where appropriate, you are responsible for providing this information to any such individuals.

How I store your personal information
Your information is securely stored in Chambers or at my home. I use reasonable technical and organisational security measures such as password protection and encryption of computer generated data and keeping paper data secure to prevent personal information from being accidentally lost or destroyed, or used or accessed in an unauthorised way.
In this connection, Chambers, as data processor, acting on my behalf, will only process your personal data on my instructions and is subject to a duty of confidentiality.
The data will be held in line with any regulatory obligations and generally be kept for 6 years but may be 12 years, or longer where, for example, the case includes information relating to a minor, from the date of completion of instructions. At this point any further retention will be reviewed and the data will be marked for deletion or marked for retention for a further period.
All data will be securely deleted or securely shredded after this time without reference to you. I will store some of your information which I need to carry out conflict checks for the rest of my career. However, this is likely to be limited only to your name and contact details and the name of the case. It will not include any information that is “sensitive information” for GDPR purposes.
