Rome II, Recital 33 and Restitutio in Integrum: DHV v Motor Insurers’ Bureau [2025] EWHC 2002 (KB)

On 31st July 2025, the High Court handed down judgment in DHV v Motor Insurers’ Bureau [2025] EWHC 2002, a significant cross-border personal injury case in which Mr Justice Dexter Dias was called upon to decide on no less than 14 substantive issues. The detailed 104-page judgment is essential reading for all practitioners engaged in cross-border litigation. In this note, Poppy Blackshaw examines the issue of greatest practical significance for claimant and defendant practitioners alike: the applicability and effect of Recital 33 of the Rome II Regulation to the assessment of damages in quantum cases to which Rome II applies.
