Charles Dougherty QC will discuss the recent significant decision of the Court of Appeal in Schubert Murphy v Law Society [2017] EWCA Civ 1295, where he acted for the successful firm.

The claim arose out of a fraud by a bogus firm of solicitors, which the Law Society had wrongly listed on its website as a genuine firm. The Court considered whether the Law Society could owe a duty of care in respect of a representation on its website as to whether someone is a solicitor.

The case engages two important points of general principle:

  • Whether a duty arises where information is provided online rather than a response to an inquiry made in person, by telephone, or in correspondence; and
  • Who should bear the risk of irrecoverable loss caused by the fraudster to the innocent client, where a solicitor is relieved in whole or in part of liability under section 61 of the Trustee Act 1925 or there is inadequate insurance cover for the whole loss.Charles is a leading professional negligence silk and is recommended in Chambers UK and Legal 500. He is also recommended in the legal directories as a leading silk for insurance, commercial litigation, commercial fraud, product liability and travel.

We would be delighted if you could join us. We will start promptly at 6.00pm. The seminar will last about 1 hour and will be followed by drinks and canapés.

This is a free event which qualifies for 1 CPD hour.
