With an introduction by Charles Dougherty QC, David Thomas and Andrew Bershadski will discuss two eagerly-awaited and important professional negligence and insurance judgments which have been handed down this week by the Supreme Court.
Gabriel v Little (BPE Solicitors and another v Hughes-Holland [2017] UKSC 21) re-considered the issues of scope of duty and the SAAMCO cap, in what is likely to become the leading authority on these fundamental points.
AIG Europe v Woodman [2017] UKSC 18, considered the thorny issue of aggregation in the context of the Law Society’s Minimum Terms and Conditions for solicitors’ professional indemnity insurance, overturning the guidance previously given by the Court of Appeal.
