Marie Louise Kinsler QC and Ruth Kennedy successful in Supreme Court case: Lungowe v Vedanta Resources plc and another
The Supreme Court handed down judgment this morning in Lungowe v Vedanta Resources plc and another  UKSC 20, a landmark case on the jurisdiction of the English court to hear a claim against a UK domiciled parent company in relation to alleged environmental abuses abroad.
The alleged abuses concern the operation of a copper mine in Zambia. The Supreme Court dismissed the appeals by Vedanta and its Zambian subsidiary, KCM, challenging jurisdiction.
The judgment addresses important issues relating to both the EU and common law rules on jurisdiction. In addition, the judgment gives guidance on the potential scope for parent company liability in the context of the subsidiary’s activities abroad.
